1. GENERAL TERMS
All drawings may or will include a subtle watermark/signature that you may not remove, obscure, or alter
Prices are subject to change based on demand
I have the right to reject any request for any reason
All pieces are commissioned with the understanding that I retain artistic freedom/license and will create art in my own style
2. PAYMENT
Currency accepted is USD and can be paid through PayPal or Venmo.
Commissions must be paid in full to begin work. In some cases, you may request a 50% non-refundable deposit that can hold a space in my workflow for a limited time but the remaining half will be required before the work can be completed.
Please do not send any payments ahead of confirmation that I'm taking on your request. Sending payment before I agree to the work may result in your request being rejected.
3. PROCESS AND DELIVERY
I will notify you when I have started on your commission. After that point, there are no rights to a refund on the work (see point 7 below for more info on refunds).
Generally, pieces are finished within one month of starting work on them. The time it takes to finish a commission varies depending on factors such as the complexity of the commissioned piece, artist health and personal wellness, and overall workload.
If anything comes up that will slow the progress of the initially estimated delivery time I will let you know ASAP.
For digital art, I will check in at the sketch stage and require your approval to move forward. The amount of further reviews depends on the complexity of the work and will be discussed beforehand.
For traditional art, I will only check in at the sketch stage if specifically requested by the commissioner beforehand, or if the piece is particularly intricate.
For tattoo designs, I will check in at least once at the sketch stage, then maybe more depending on the design and how much license you want me to have.
Once your piece is finished, you will receive either the full-resolution image via email (for digital) or the original piece shipped to you (for traditional). Shipping costs are calculated and added to the price of the piece.
4. REVISIONS
If reference images or provided details are insufficient for your commission, later changes will inevitably add extra charge for the work being done to figure out your piece. Please be as detailed as possible at the request stage, especially if you do not have sufficient visual references!
The amount charged for revisions depends on the change you request and the time and effort involved to make it.
A redraw of a finished or nearly finished piece on account of requested changes will be treated as a separate commission and charged as such.
For tattoo designs: significant revisions to the overall concept or layout are limited to 3. Other changes are alright as long as they are minor, but excessive changes to the design will start to add additional charge for time spent on your piece.
For digital art: once I start on your piece, you will be sent an initial sketch where you can request any needed changes. Later revisions may be subject to additional charges if:
you wish for me to change something significant that either you had previously approved, not mentioned, or was otherwise not confirmed with/made known to me
you want to make changes to the completed piece
For traditional art: revisions are unfortunately not able to be done. Changes are extremely difficult if not impossible to make without restarting the work. All requests for approvals (sketch approval, color approval, etc.) must be made known at the time of the commission request.
5. COPYRIGHT / USAGE POLICY
I, Shannon Fleck (the artist), claim the rights to the produced drawing, not the buyer. I reserve the full rights to the image and its use/distribution. I am allowed to use the copyrighted artwork to:
Promote myself
Publish books (artbooks, etc.)
Display and/or post it anywhere (website, social media, etc.) unless otherwise explicitly agreed
The buyer is allowed to:
Use the commissioned piece for personal use (can be tattooed, uploaded to social media profiles, forums, etc. with artist credit)
Display the artwork publicly with artist credit
Use the art in tandem with a project or brand for commercial gain ONLY with artist knowledge, consent, and a written agreement
The following is considered copyright infringement:
Reproducing/photographing/reselling my artwork commercially and making money off of my work in any way not explicitly agreed
Tracing or drawing over my artwork
Claiming my artwork as your own
Removing my signature from my artwork
Altering my artwork without my consent
Training AI with my artwork
Anything else that I deem unacceptable use of my artwork
6. CUSTOMER SATISFACTION
I want to do everything I can to make my clients happy with their piece! For this reason I highly suggest that you tell me everything you need as early as possible in the commission process. I am happy to accommodate reasonable requests and help find solutions!
It is on the commissioner to express all of their needs and requests upfront. I am happy to check in with you during the art process if you would like a certain level of oversight on the artwork, but this must be made known before I spend time and effort on your piece.
If you are unhappy with anything in regards to a final piece, please understand that I am strict on my refund policies in order to protect myself and my work. Dissatisfaction with a finished piece or with my style is not considered grounds for a refund unless I make a mistake with something you asked for in the piece. Demands or any other aggressive or retaliatory behavior about refunds on artwork will not be tolerated.
Understand the nature of my art: it is created by me, in my style, and through my personal envisioning and process. After all, hopefully that is why you are here! I promise to always leave you with a piece that I am glad to see go into the world.
I am willing to be flexible with some of my terms for you if you ask before I start on your commission. For example, if you don't want me to post your art anywhere, we can discuss this. Payment policies are fairly immovable, but in extenuating circumstances there may be different arrangements that we can make: please reach out if you have a need and we can talk about it!
7. REFUND / CANCELLATION POLICY
Refunds of any kind are strictly not allowed once work on the commission has begun.
If for any reason I am unable to continue work on your commission, you will receive a full refund.
If you need to cancel your order due to an unforeseen emergency, a partial refund may be possible. This will depend on the circumstance and amount of work completed, and is at the artist's discretion to provide.
If you have had a refund approved, do not request a chargeback. I will transfer the money back to you myself.
If you request a chargeback at any point when a refund was not approved by the artist, you will lose all aforementioned rights to the commissioned piece. Furthermore, you will be blacklisted from commissioning me again.
If the buyer breaks any of the terms stated above, all rights to the commissioned artwork will be forfeit to me, Shannon Fleck (the artist), and I will have the right to use the artwork in any way I see fit.
